Terms of use

These terms govern the transactions with Raed Innovations Private Limited (“the Company”) including your use of the website www.raedlife.com (“the website”). By using the website, you signify your agreement to be bound by the conditions in the Terms of Use, Privacy Policy and other terms which govern the website (collectively referred to as “Terms”).

1. Definition

1.1. “Applicable Law” means any statute, law, regulation, ordinance, rule, judgment, order, decree, bye-law, approval, resolution, order, directive, guideline, policy or other similar form of decision of, or determination by, or any interpretation or adjudication, in each case, by any concerned Government Authority having jurisdiction over the matter in question in India, as may be applicable, and having the force of law;

1.2. “Exchanged Product” means the product which you wish to exchange after purchase;

1.3. “New Product” means the product which you wish to purchase and product you wish to purchase in exchange of an exchanged product; 

1.4. “Shipping Partner” means and includes courier services which are partnered with The Company for the delivery, exchange or any interconnected activity with regard to delivery of a product but are in no way related to The Company and are independent third-party service providers; 

1.5. “Working Days” means Monday to Friday and excludes all public holidays.

2. Interpretation

2.1. Words in the singular shall include the plural and vice versa. Further, the use of words in the singular or plural, or with a particular gender, shall not limit the scope or exclude the application of any provision of this Agreement to any person or persons or circumstances except as the context otherwise permits.

2.2. The word “or” is disjunctive, but not necessarily exclusive.

2.3. Any term defined in a particular tense will include tenses of that term.

3. Business of the Company

3.1. Raed Innovations Private Limited is a trader engaged in retail and wholesale trade principally through e-commerce platforms including its own platform www.raedlife.com and social media accounts. The primary focus of the Company is the sale and distribution of sports and fitness equipment and accessories.

4. Orders and payment 

4.1. We may require you to register with our website and provide certain basic information necessary to process the order and delivery the products and services to you. The information we collect from you will be governed by our Privacy Policy.

4.2. We may charge shipping in addition to the price of the products and applicable taxes. The total price charged to the customer will be displayed before you place the order or make the payment.

4.3. We accept payment electronically only. Currently cash on delivery facility is not available. The order page will display up-to-date information regarding payment methods we accept.

5. Delivery and shipping 

5.1. The product will be dispatched within 3 working days. The shipping of the product is under the supervision and control of the shipping partner. In any case, our shipping partners and we will work expediently and deliver your product within the stated shipping time. You may track your product and the estimated date of delivery on your user account.

5.2. However, delivery is subject to circumstances beyond our control and we will not be liable for any delay caused due to any accident or reason beyond our control. 

5.3. In case nobody is available to receive the product, it will be sent to shipment centre or the supplier. In this case you will be liable for the charges of re-delivery, if any. If the order is subsequently cancelled, you will be liable for all the shipping charges and [%] of restocking fee. No cancellation is possible in customised items.

6. Refund and exchange policy 

6.1. NO CANCELLATION, RETURN OR EXCHANGE IS POSSIBLE IN CASE OF PERSONALIZED/ CUSTOMIZED ITEMS, OR ITEMS WHICH ARE SPECIFIED AS NON-RETURNABLE/ NON-EXCHANGEABLE AT THE TIME OF PURCHASE.

6.2. Items other than personalized/ customized items, may be returned or exchanged in the following circumstances: 

(a) Request for exchange or return is initiated within 7 days of delivery;

(b) The product has not been damaged or altered in any way; 

(c) The product has not been worn or used;

(d) The product and its original packaging, price tags, brand tags are intact and fit for return or exchange.

6.3. Request for refund/ exchange will be subject to scrutiny and final decision by the manufacturer/ supplier, and if the request for refund/ exchange is found not to be genuine, the same item will be returned and any additional charges (subject to terms and conditions of the delivery partner) will be payable.

6.4. We reserve the right to reject any request for return or exchange if it does not meet the return and exchange policy.

6.5. If the product returned does not meet the return and exchange policy, the same item will be resent to you at your costs towards shipping. If it is found that the packaging you sent for return is empty or damaged, you shall be responsible for the loss of the product. 

Refund

6.6. Refund in respect of a returned product will be initiated after we have received and inspected the returned package and is determined fit for return. Once the returned product is determined to be eligible for return & refund, we will initiate refund of the price of the product excluding the shipping charges within 14 working days, subject to any delays occasioned by circumstances beyond our control. 

6.7. The refund amount being credited to the account from which the amount was deducted is subject to the working of the particular bank or PPI issuer. Once refund is initiated, we do not have any control over the processing of the refund. However, we will extend cooperation in this regard only to the extent of coordinating with the bank or the PPI issuer. We will not refund the amount in any other way or mode. 

Replacement/ Exchange

6.8. You can request for replacement of an item purchased if the item was delivered to you in damaged condition. We will try to replace the item without any additional charges to you. However, depending on other circumstances, we may charge additional shipping charges.

6.9. You can exchange the product purchased, provided the new item is of the same or higher price than the original item sought to be exchanged. 

6.10. The shipping of new item will be commenced once we have received the exchanged item and have verified the same. Once we determine the returned product to be eligible for exchange, the new product will be shipped expeditiously. 

Cancellation

6.11. You are permitted to cancel orders prior to its dispatch from our facility. In all events prior to dispatch of purchased products, we shall initiate refund within 14 days from the date on which we receive the request of cancellation from you.

6.12. We do not accept cancellation of orders post-dispatch. 

7. Promotions

7.1. All promotional coupons codes/vouchers are subject to terms and conditions as follows:

7.1.1. Delivery charges where applicable are not covered in the value of the order.

7.1.2. We will accept no liability for any loss and/or damage to promotional vouchers under any circumstances.

7.1.3. We reserve the right to withdraw any coupons or vouchers at any time at our discretion without any prior notice.

8. Intellectual property 

8.1. All materials (excluding third-party owned intellectual property), including software, codes, images, text, illustrations, designs, icons, photographs, videos, names, logos and other materials displayed on the website are the intellectual property of The Company, which has exclusive right, title and interest therein. Your access to the website shall not confer and shall not be considered as conferring upon you or any third party any right, title or interest on our intellectual property rights. You shall not commercially exploit any of our intellectual property. 

8.2. The Company names and logos and all related product and service names, design marks and catch phrases are the trademarks or service marks of The Company. Your access to website does not authorise you or any third party to use any name, logo, mark or catchphrase in any manner. 

8.3. We are not responsible for the content of any third-party sites and do not make any representations regarding the content or accuracy of material on such sites. If you decide to link to any such third-party websites, you do so entirely at your own risk.

9. User privacy

9.1. All information with regard to your data and information shall be governed by these Terms and the “Privacy Policy”.

10. Representation and warranties 

10.1. We shall make all efforts to keep the information on the website accurate but we do not guarantee or endorse the accuracy, completeness or quality of the information, products, third party information and other material contained on the website. The website and the materials, information and references to the products and services, including but not limited to images, text, illustrations, designs, icons, photographs, programs, videos, written material are provided on “as is” basis without representations or warranties. 

10.2. We do not endorse or guarantee the usefulness of any images, text, illustrations, designs, icons, photographs, programs, videos, written material. 

10.3. We shall not be liable for any malfunction, virus attack, software and hardware issues that you may face while transacting with us. 

11. Limitation of Liability 

11.1. Our entire liability, and your exclusive remedy, in law, in equity, or otherwise, with respect to the website, the products, the services and/or for any breach of this agreement is solely limited to the amount you paid excluding shipping and other charges for interconnected transactions for that particular transaction in dispute. 

11.2. We shall not be liable for any direct, indirect, incidental, special or consequential damages in connection with any transaction, the products or the services in any manner. We shall not be liable to compensate under any circumstance except as expressly provided in these Terms. 

11.3. We shall not be responsible for any act or omission by us in good faith. We shall not be liable for the acts and omissions of the shipping partner, or any other third-party.

11.4. We make no representation that the website, the products or services are appropriate or suitable or available for use in locations outside India. You may access the website from outside India at your own risk and initiative and must bear all responsibility for compliance with any applicable foreign laws. We make no representations as to suitability or usefulness of the products and service to individual customers, and the customers are advised to determine the same for themselves.

12. Governing law

12.1. This Agreement will be governed by the laws of India. You hereby agree that all disputes arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the Courts located in Jamshedpur, Jharkhand. By using the website purchasing the products or availing the services, you consent to the jurisdiction and venue of such courts in connection with any action, suit, proceeding or claim arising under or by reason of this Agreement. 

13. Changes to the Terms

13.1. We reserve the right at our discretion, to change, modify, add or remove portions of these Terms and Conditions at any time. Please check these terms periodically for changes. Your continued use of the Site will mean that you accept the changes to these Terms and Conditions.
